In one case, the Armed Forces Tribunal (AFT) has ordered the Army to treat the soldier’s 25-year-old son. According to the rules, the age limit is 25 years and 18 years for the daughter to provide treatment to the soldier’s son.
The case is related to retired havildar Awadhesh Kumar, resident of Rae Bareli. His 29-year-old son Arvind’s two kidneys have failed. The Army refused to treat him in April last year, stating that the disease is not on the list of ‘Disabled Persons Act-2016’. The son’s age is also more than 25 years. On this, Havildar filed an appeal in AFT.
The victim’s advocate Pankaj Kumar Shukla cited a letter from the Ministry of Defense in the court. It calls for treatment on 40 percent or more disability. He argued that Havildar’s son is 80 per cent disabled, so it is illegal for the army to refuse treatment. Accepting the petition, a bench of Judge UC Srivastava and Vice Admiral AR Karve issued an order for treatment to the army.
